Dukes still faces charges in Ben Hill County for allegedly burning Grinstead's body on his uncle's pecan orchard, and in Houston County for allegedly sexually assaulting two women at gunpoint.
The warrant states Dukes was supposed to appear in court Jan. 3 on concealing a death of another, tampering with evidence and hindering apprehension or punishment of a criminal charges in the Grinstead case.
So is “concealing a death” a different charge than a charge for actually burning a body? Both Bo and Ryan were already convicted of concealing Tara’s death, Bo in Wilcox and Ryan in Irwin. Is concealing a death related to them lying about their knowledge but something like “desecration of a corpse” would be a charge for the actual act? Would it be double jeopardy if Ryan is charged in Ben Hill County if he was already convicted of concealing a death in Irwin county even through the actual venue appears to be the pecan orchard and not her house? (Jury caught onto the venue issue but chose to ignore the technicality). Same with Bo in Ben Hill if he was already convicted in Wilcox? My point- both Ryan and Bo have already been convicted of concealing a death in 2 counties that are not where the pecan orchard is (Ben Hill). To avoid the venue/double jeopardy issue. Wouldn’t charges need to be different?
@leesburgnative interesting thanks! I wonder if Ryan could be charged with the same in Ben Hill? An evidence tampering charge could be outside of double jeopardy. Prosecutor said “at least one more case.”
When she said one more case I think she was referring to Bo's charges in Ben Hill. I think a good defense attorney can argue SOL issues in Ben Hill and maybe that is why they charged it the way they did in Wilcox. I am not sure. I didn't watch him Wilcox County trial - I think I will go back and do that :)
