RYAN DUKE’S APPLICATION FOR INTERLOCUTORY REVIEW

A couple of things I found interesting in the Supreme Court filing by Ryan's attorneys yesterday..... I'm still so baffled by the fact there are 3 contributors on the glove. Will this all ever end? 1. The Evidence As noted above, the only physical evidence in this case linking Mr. Duke to the alleged crime scene are alleged skin cells and partial fingerprints pulled from a latex glove found outside of the victim’s residence in October 2005. The State intends to introduce evidence at trial that the glove contains DNA material from Mr. Duke. The DNA material found on the glove, however, is limited to “touch DNA” from at least three individuals.1 An alleged co-conspirator in the case, Bo Dukes, and others have not been not ruled out by the GBI’s testing as contributors to the DNA mixture on the glove. Notably, since Mr. Duke was charged with Ms.Grinstead’s murder, Bo Dukes has subsequently been arrested and charged in connection with the alleged false imprisonment and rape of at least two women. 1 The GBI’s testing assumed that there are three distinct contributor s to the DNA mixture on the glove. However, the number of contributors is often subject to reasonable dispute by experts in the field of touch DNA. The False Confession 1. The Evidence Mr. Duke was arrested after providing an oral and brief written statement to GBI investigators in which he purportedly confessed to the crimes charged here. Mr. Duke’s statements to the GBI, however, were made while he was under the influence of narcotics and after having been contacted by an alleged coconspirator, Bo Dukes,4 the previous evening who worked to coerce Mr. Duke into confessing to the murder while minimizing Bo Dukes’ involvement. The veracity of Mr. Duke’s statements to the GBI is undercut not only by the influence that the narcotics had on his mental state, but also the significant inconsistencies between his statements and the purported facts of this case demonstrated by other significant evidence to the contrary that will be presented. Moreover, as explained above, the only piece of physical evidence in this case linking Mr. Duke to the crimes charged in this case is the latex glove found outside the victim’s home and DNA thereon alleged to be from Mr. Duke’s skin cells. Mr. Duke’s statements to the GBI will therefore take center stage at trial and will be incredibly significant for the jury. 4 Unbeknownst to Mr. Duke at the time, Bo Dukes had preemptively contacted law enforcement and provided statements implicating Mr. Duke in the murder of Ms. Grinstead. Mr. Dukes was subsequently arrested and is currently incarcerated on charges of sexual assault elsewhere in Georgia while on federal probation.

Speaking of scant physical evidence... I tought that much discussion was had about a year and a half ago about the white truck/black truck ( hell if I can remember which) that was used in the commission of the crime. I believe I was told that BJ was instrumental in locating the vehicle, kudos to her, and furthermore that there was evidence in the truck that tied Tara and Ryan together. While I remember she was quite cryptic about this evidence, she was definitely implying that it existed and had us all play a guessing game as to what it was. If anyone remembers this post, pease link it, thanks

Yes I never understood going down that rabbit hole as well lex. In reading through the thread, we were lead to believe there was a connection w the white truck, Tara and Ryan (carpet fibers, DNA). Yet, In the filings, there is no such evidence acc to the defense team. There is a confession and touch DNA on the glove and no other Ryan evidence acc to them. @bjbj what made you think there was Ryan white truck evidence? Did someone share that with you?

AHHHHHH thank you Southga, I'm gonna go check it out now!!! I knew I remembered that post and if it is the same one I remember thinking about what DNA might be left after so long and if so, how much would be able to be collected due to degradation, contamination, cleaning, and who knows how many other factors.... I truly appreciate you locating that post....

Unless I missed something, which is possible because I skimmed through the post you shared pretty quickly, i don't think that is the exact post I'm looking for. What I was hoping to find is the one where BJ talks about DNA being in the truck that links Ryan to Tara. I think the post you shared was pertaining to the history of the black truck with regards to it's ownership history ( along with what seemed to be a lengthy defense of Bo by none other than Brooke). It's way to late tonight but I will look for it tomorrow. Thank you, though...

I never said there was any DNA found. I was simply clarifying that the truck used was a white truck and that it had been located and examined by LE. I shared all of the data and photos on here at the time.

I for sure deduced their was DNA and felt you intimated there was based on the below. The majority of the thread was hinting at DNA. georgia1234 12 Sep 2017 a1 IF the story Bo claims is true re white truck, I've always hoped the GBI was able to do DNA testing to see if she indeed was transported in that truck. @bjbj im confused so was nothing found in bo's F150 it was just located with someone that was linked to someone in that comunity ?

Please re-read my comment. I never said one way or another that any DNA was found in the truck. I said it was located. I said they GBI examined it.
