I think the judge is going to come down as hard as he legally can.
I think so too Jess.
I feel Reinhardt will throw the book and go the Max penalty at ryan but how can they officialy give him any more time in his sentence with the statute of limitation being 100% relevant did Ashleigh leave it to late to raise it before the judge she said she was going to call Alan Morgan and the paulks but because garland lott entered it into evidence they held off
@twopancakes yes the time Ryan has served will count towards his sentence. The maximum allowable by law is ten years. He has served five. Worst case scenario he will get five served, five more to serve.
@osmosis what???
At the end of the court hearing she asked for the motion of the statute Ashleigh said she held of filing it during the case as there was no evidence but with garlands testimony it entered it into evidence she said she was going to call the paulks and potentially Alan Morgan but because garland entered it they felt it was best to leave it till after the verdict
Osmosis, I wish I understood how that works. I feel like this judge has been very biased.
Are there any legal penalties or consequences for his lies to JS? Curious be I really don’t know
Miss_bee I actually thought the judge was fairer than the first few hearings and I know the community and family need these guys to serve time for this heinous crime but is it out of his hands or not if he does give ryan the Max for count 6 I feel Ashleigh has very good grounds for appeal
You can’t appeal a not guilty verdict. He confessed to the crime of concealing a body. No grounds for appeal, no need for appeal.
Bo got the following: STATE OF GEORGIA - CURRENT SENTENCES CASE NO: 866837 OFFENSE: CONCEAL DEATH OF ANOTHER CONVICTION COUNTY: WILCOX COUNTY CRIME COMMIT DATE: 06/16/2016 SENTENCE LENGTH: 10 YEARS, 0 MONTHS, 0 DAYS CASE NO: 866837 OFFENSE: HINDERING APPREH OR PUN CONVICTION COUNTY: WILCOX COUNTY CRIME COMMIT DATE: 06/16/2016 SENTENCE LENGTH: 5 YEARS, 0 MONTHS, 0 DAYS CASE NO: 866837 OFFENSE: FALSE STATEMENTS GOVT CONVICTION COUNTY: WILCOX COUNTY CRIME COMMIT DATE: 06/16/2016 SENTENCE LENGTH: 5 YEARS, 0 MONTHS, 0 DAYS CASE NO: 866837 OFFENSE: FALSE STATEMENTS GOVT CONVICTION COUNTY: WILCOX COUNTY CRIME COMMIT DATE: 06/16/2016 SENTENCE LENGTH: 5 YEARS, 0 MONTHS, 0 DAYS STATE OF GEORGIA - PRIOR SENTENCES STATE OF GEORGIA - INCARCERATION HISTORY INCARCERATION BEGIN: 04/02/2019 INCARCERATION END: ACTIVE
@atlantaanne he was found guilty on charge 6 for concealing a crime the defense has asked in a motion that the statute be recognised as it was entered into the case file within the 5 year period
@ sandiebirdie yes, but he wasn’t charged with giving false statements to law enforcement.
The statute begins when law enforcement is first aware of the crime
@precon then I am wondering how they were able to charge him for concealing a death..?
Those charges were in Wilcox county and were related to him lying to the GBI in 2016. If he were charged with burning the body in 2005 that would be in Ben hill county.
Just FYI, I am referring to Ryan's current charge and impending sentencing...not Bo.
I struggle with the charge and would love to hear from the jury on this. He is definitely guilty of concealment… but not in irwin county. I feel that’s why the jury kept asking the questions about venue. Unless, they felt like some of the evidence presented supported concealment. I don’t know. I feel like if jurors believed this testimony then he would be not guilty on all counts (in irwin county) but if they didn’t believe it, then I feel they would have found him guilty on all counts. This leads me to believe they wanted to charge him for concealment even though it wasn’t in irwin county.
So do we know where Ryan is currently being held? County jail seems like? I couldn't find a jail roster look up for Irwin County. Tried the GA Dept. of Corrections and he's not in there yet.
Did anyone else notice that at sentencing the prosecutor mentioned needing to hold on to the charred bone evidence because there is “at least one more case to try.” And in the press conference after, Ben hill county was referenced as well as clarification that they will not pursue murder charges against Bo. Any thoughts that they are going bring more charges on Ryan and/or Bo related to burning her body at the orchard? Although Bo was found guilty of concealing a death in Wilcox Co. no? and this jury convicted Ryan of concealing a death despite the clear venue issue being iffy. Are there other charges in GA that wouldn’t be considered double jeopardy? (Desecration of a corpse, destruction of evidence, etc) . I would also think the statue of limitations would be an issue for those charges but also could be “tolled” since GBI was unaware of the crime until 2017 (like the non-murder charges against Ryan). I suspect more to come. Thoughts??
